I have seen that kind of situation a number of times and will give up my seat for a couples, old folks and disabled. If I'm sitting alone I can be really flexible where I sit. Since I DO NOT sun my only criteria is there is shade.
Random acts of kindness make peoples day. It costs NOTHING to be nice and makes a much better impresion than being difficult.
I guess I'm old fashioned.
