As regards your last post, the operative term is "reasonable." An excellent legal interpretation of "reasonable" is what the averaqe thinking
individual would do in like or similar circumstances.
Inasmuch as were one to poll one thousand average thinking American citizens of an eclectic mix of ethnic backgrounds, I think it would be a safe wager (actually more of a guaranteed one) that better than 990 of them would associate the term "African American" with a person of color, no?
Also to use your methodology, one would easily construe the same term to refer to a person who poured a bucket of paint over the top of their head. Don't think that would happen either.
