Default Question about custody letters

Okay, this topic was touched in another post but figured I would ask my question in a new post hoping it gets read

Regarding custody letters for children under 18

We (me, my boyfriend, and my 2 children) are leaving for our cruise on the 28th of this month and I don't have a letter. My son is 18 so I am assuming I don't need one. My daughter just turned 17 last month, but I wasn't told I needed one.
I am in the middle of a divorce. My lawyer hasn't been able to locate my "ex" and we (the kids and I) haven't seen or heard from him in ohhhhhhh I would say 10 years. He just upped and left one day. So, technically I am their custodial parent, but don't have court documents saying so.
I hope this isn't going to be a problem

**oh, editing to add: we are not going out of the country - we are leaving from our home state of NY and going to the caribbean (san juan, st. thomas, and tortola)......we are only using birth certificates and photo IDs (except BF, he has a passport)

Your lawyer can advise you on this one, and can get a court order or some kind indicating you are their sole legal guardian and explaining the circumstances. Since you are their mother, and your name is on their birth certificates, I would advise bringing certified copies of their birth certificates, as well as your own.

I would doubt they are even going to question a 17 yr.

I don't think you are going to necessarily have any problems, but your belief that you are not leaving the country is wrong - Tortola is part of the British Virgin Islands and, yes, you are leaving the country by visiting Tortola. Even if you never leave the ship in Tortola, immigrations will have considered you as having left the country and you will be subject to whatever rules are involved upon your return.

I wouldn't necessarily advise this, but we did not have a certified letter when taking my stepson on our last cruise. He lives with us, but his mother has partial custody too...she gets him every other weekend and every other holiday. Plus he just moved in with us in August 2005 and we cruised in April 2006. He was 14 at the time. I was a little worried, but DH was not so nothing legal was done prior to the trip.

We were NEVER questioned regarding custody. I guess because the three of us all have the same last name and I had certified birth certificates for all 3 of us.

I agree with jackiesbooks that you will probably not be questioned - but since you have a lawyer that knows the situation it is best to bring a document from him.
