The blurb said it was a small claims case, which in most cases means there was no lawyer involved. In my experience, even a bad lawyer (and I've known a few) could not have written a statement in a court paper as illiterate as the one quoted in the article.

Clearly then, it must have been the cruise line (and its lawyers) that took it on to the appeals court (because the wacky lady would have been happy with the small claims court's ruling).

It's just another one of our fellow citizens who shouldn't be allowed out of the home. But they are, and they get to vote and reproduce and there's nothing we can do about it. Sometimes they're good for a laugh, and that's about the best we can hope for.

I can't believe someone would sue a cruiseline for this, just no basis at all....What is the fastest a ship can travel, 25 knotts may-be?? Everyone here knows there is always that risk of being sea sick, but it goes when you take a cruise, right?

What they should do if you file a law suit and it gets thrown out then you should have to pay a pre determinded amount that might stop alot of these silly claims

I agree, court costs are not cheap, may make people think twice about filing a lawsuit.

No, no, Manuel-- if there was a lawyer involved and you kicked his arse, you would be in danger of doing damage to his brain!! We wouldn't want another brainless lawyer on the loose.

and have the railings all lowered 18 inches or so.

I often wonder what would happen if the company being sued defended their case successfully then turned around & counter-sued for loss of business, damges, costs of defence, libel / defamation of character or whatever the correct term would be.

After all all the evidence they would need would already be nicely filed & recorded with the courts.

I have a sign on the wall near my desk at work that tends to apply to some of the people I have to deal with, and I believe it applies to this woman as well. The sign reads "You're a special kind of stupid, aren't you?"

It's a shame the SS United States still isn't in trim. They could put her on it and then proceed across the North Atlantic in winter time at about 47 knots into a 30 mph headwind and tell her to go take a stroll on the promenade. She'd probably be throwing up as she sailed off the stern!

Just got of Eurodam, and in my opinion, she was going far faster than she should have been (though I'm not about to sue anybody)

The first part of the week, she was breaking 20 nauts (knauts?). Far too fast imho for a ship of her size. Add to that rough, high waters, high winds, and the boat was a rocking! I was seasick for the first time in my life. We spent most of the cruise doped up on bonnine. The last part of the trip, the Captain slowed down to about 12 knauts and it was much more pleasant.

Perhaps fast for conditions, but not fast. The alternative is to adjust timetables and give up a port.

I know that you can't please everyone, and most would have been up in arms if a port were missed, but I would have preferred calmer sailing so I could enjoy my time on board. I think a lot had to do with the size of the ship. I spoke to people on Alure and Oasis, and they had no clue that there were rough waters. I know that is the extreme, but still. I met someone at a CVS in San Juan who was on one of the Seabourn ships. She too, was seasick for the first time in her life. I spoke to many on our ship who said the same thing. For the comfort of the pax, the captain needs to adjust the port-itensive itineraries when demanded by the sailing conditions.
