News is reporting today that passengers on the Disney Magic are sick with a stomach virus. I hope it is not the same virus as HAL. Intersting though - it is due back in port tomorrow.
Let me ask what may seem to some to be a silly question. I have seen were lawsuits have been filed against Holland America over this "virus" and no doubt someone will sue Disney.
How are the cruiselines liable for something like this, and if so, the next time I get sick, can I sue the airline, the cruise line, or my neighbor who may have given me a bug? Where does it end?
The suit is going to claim the cruiseline did not inform the passengers of this continuing problem and therefore did not permit them to make a decision to cancel their cruise to avoid getting sick and ruining their vacation. The cruiseline had known of this virus infection but neglected to take reasonable measures to protect the innocent public. Since it is possible the virus is being transmitted by the products served to the passengers the culpability of the cruiseline can not be disregarded.
I would think if a particular hotel had the same problem occuring for weeks and neglected to inform incoming guests that they have had an outbreak of a virus they would be looked at also.
